Rape trial jury discharged

The jury in the trial of a thirty-seven years old man accused of raping a fifteen years old schoolgirl in his car at Sandbank Cottages eight years ago was unexpectedly discharged on the fourth day of the case at the Crown Court in Derry yesterday.
Judge Desmond Marrinan Q.C told the jurors that, in the interests of justice, he had no option but to discharge them.
Judge Marrinan made his decision, which was accepted by both defence and prosecuting counsel, following legal submissions in the absence of the jury.
The defendant, Keith Burnside, from Rosemount Gardens, denies raping the girl in February 2000.
The defendant was released on continuing bail pending a second trial.
That trial is expected to start at the beginning of December.
