A Donegal company has been fined more than £1,000 for allowing an employee to drive a van in a dangerous condition.
Gill Excavations Ltd, who are based in Clonmany, Co.Donegal, pleaded guilty to failing to display a front number plate, permitting use of a goods vehicle in a dangerous condition and defective tachograph in April, last year.
Derry Magistrate’s Court yesterday heard the defects were discovered after the vehicle was involved in a collision on the Crescent Link.
The court was told there was a fatality in this collision, however the defects were not the cause.
Defence solicitor Ciaran McGuinness said his clients wished to “express their remorse about the circumstances of this incident and the loss of life”.
He said the company were not aware of the defects in the van and it would not be in their nature to let a vehicle be on the road in this condition.
Fining Gill Excavations Ltd a total of £1050, District Judge Barney McElholm said: “This is a vehicle that clearly had not been maintained properly.”
