The 29-year-old was further charged with assaulting the woman between June 19 and July 24.

Earlier this morning, a prosecutor told Derry Magistrates Court that there had been a ‘material change in the available evidence’ and there was an application to withdraw the charges.

He added that the case had been reviewed by a senior prosecutor and the ‘available evidence no longer meets the test for prosecution’.

Gheorghe had been remanded in custody following his first appearance in court.

Deputy District Judge Sean O’Hare granted the application to withdraw the charges and ordered the immediate release of the Gheorghe.
