A 20-year-old who bit a shop assistant has been jailed for three months.

Marc Villa, whose address was given as Meridian Apartments, John Street, pleaded guilty to common assault, theft, assaulting and resisting police on February 5.

He also admitted disorderly behaviour and assault on police on February 23, last year.

Derry Magistrates Court heard Villa stole a can of fanta from a shop on the Strand Road and when he was challenged by staff member he assaulted him. He headbutted, punched and bit the injured party’s hand.

It was revealed the skin on the man’s hand was broken and blood was drawn.

Villa was arrested a short distance away after being identified on CCTV.

In February last year, Villa was involved in an altercation with three other males in the Hawthorn Terrace area of the city.

Police tried to intervene and the 20-year-old lashed out and struggled with officers.

When he was placed in a police vehicle, Villa banged his head off armoured glass and kicked a police officer as she was driving. She sustained an injury to her rotator cuff and received treatment in hospital.

Defence solicitor Maeliosa Barr told the court that the incident last year was fuelled by alcohol and other substances.

He said Villa has had difficulties with alcohol and illegal substances.

He added his client has been in custody since April this year because he couldn’t beat his drug problem ‘on the outside’.

Jailing Villa, District Judge Peter Magill said these are ‘serious offences’ and the only way to deal with them is with a custodial sentence.
