The Derry solicitor who’s joined forces with one of America’s most highly regarded law companies says he’s looking forward to be getting involved in a global fraud crackdown.
Des Doherty, of Desmond J Doherty Solicitors in Clarendon Street has been handpicked by prominent Washington DC law firm Stein Mitchell Muse and Cipollone LLP (SMMC) to help identify potential government fraud lawsuits of the type which have returned more than $34 billion dollars to US government authorities.
Speaking to the Journal about the partnership, Mr. Doherty said it was huge recognition for his company who have had maintained “strong links” with Washington over a number of years.
Robert Muse, an SMCC partner said: “We have identified Derry solicitor Des Doherty as someone we can work with as we investigate cases in Ireland and further afield in Europe in view of the amount of American companies based there. We have had a professional relationship with Mr. Doherty’s firm for many years.”
Responding, Mr Doherty said: “This is the internationalisation of these type of cases. So many US firms have set up in Ireland and the EU and there are plenty examples of where these types of laws - known as ‘qui tam’ laws have been enforced. Basically, I’ll be a conduit for any clients who come forward.”
Qui Tam laws give private individuals a financial incentive to report to the US government a fraud involving public funds, file a lawsuit on behalf of the government to recover the funds, and share in the proceeds of a successful recovery.
Concluding, Mr. Doherty told the Journal: “Many of these cases are multi million dollar cases played out nationally and globally and it’s fantastic to think that a law firm right here in Derry will be playing a key part in this.”
