Doctor accused of assault had date rape drug in her system

A doctor accused of assaulting police had a date rape drug in her system at the time, a court has heard.

Eireann Kerr, of Marlborough Park South, is charged with assaulting and resisting police and disorderly behaviour.

The charges relate to an alleged incident on December 13, last year.

Derry Magistrates Court heard the 31-year-old denies the offences and the case is listed for contest next month.

Defence solicitor Derwyn Harvey told the court that they had obtained a toxicology report which showed the presence of a drug commonly used to facilitate sexual assault.

He said a hair follicle was tested which identified the presence of GHB.

Mr Harvey said his client is a woman of good character and she had ‘absolutely no knowledge this drug was in her system’.

The solicitor told the court this report ‘changes everything from the defence perspective’.

The toxicology report is to be served on the Public Prosecution Service and the case will be mentioned again on May 29.
