Boy (14) back in custody after bail breaches

A teenager accused of assaulting an elderly couple outside their home has been remanded in custody after breaching bail conditions for a second time.

The 14-year-old, who cannot be named because of his age, is charged with grievous bodily harm, common assault and possession of a knife.

The charges relate to an alleged incident in the Racecourse Road area of the city on June 20.

An investigating officer told Derry Magistrate’s Court the teen’s mother phoned police when he didn’t come home for two days.

When police went looking for the teen he was found a short distance from the alleged injured party’s home, in spite of a bail condition banning him from going within 100m of their address.

Defence solicitor Leonie Breslin said no application for bail would be made on behalf of the teen as his mother was unwilling to have him at home.

District Judge Barney McElholm told the court that even if the 14-year-old did have an address he would not get bail as he “has no intention of sticking to any bail conditions”.

The judge added that “everytime I remand him into custody the High Court let him out”.

The 14-year-old was remanded to the Juvenile Justice Centre and will appear in court again via videolink on August 16.
