Defendant’s partner goes into labour after sentencing
A Glengad man, convicted of driving offences and fined £2,015, will miss the birth of his third child after his partner went into labour following the hearing at Derry Magistrate’s Court.
A bench warrant for the non-payment of fines was issued immediately following yesterday’s hearing and Michael McColgan was taken into custody.
Moments later an ambulance was ordered to the Bishop Street court house for his pregnant partner.
McColgan of Seaview Cottages, Glengad, was arrested on the foot of a bench warrant on Saturday November 10.
District Judge Barney McElholm heard that a member of the public observed a drunken male driving off from the Brunswick Superbowl in a Honda Civic car. When stopped, he smelled of drink and “staggered” from the car. A preliminary breath test showed that he had 80mgs of alcohol per 100ml of breath.
The court heard the defendant made full admissions during police interview. He also admitted charges of having no driving licence and driving without insurance.
McColgan was also arrested on foot of a bench warrant following offences in 2005. PSNI officers saw a motorist on Lawrence Hill driving without lights on, and the police vehicle was then forced to take evasive action to avoid a collision. His reading was 79mgs of alcohol per 100 mls of breath. The legal limit is 35mgs.
Defending solicitor Paddy McDaid said: “My client realises that a period of custody is inevitable as he has no money to pay the fines. His partner is due any time this week.”
McColgan was fined a total of £2015 and disqualified from driving for six years.
