Jailed for double assault on girlfriend
A man who grabbed his girlfriend by the throat until she passed out has been jailed for six months at the local Magistrate’s Court.
James Anthony Edward Moore, of Cornshell Fields, pleaded guilty to three charges of common assault, resisting police and failing to answer bail.
Jailing the 20-year-old and fining him £200, District Judge Barney McElholm said such assaults would not be tolerated by the courts.
“Some males cannot conduct themselves in a relationship with a female without adopting this power domination idea whereby they lash out if things don’t go their way. It seems to me the only way they can cope in a relationship if they don’t get their own way, is to hit”, the judge commented.
He said Moore was “going to have to realise that will not be tolerated by the court”.
The charges relate to two separate incidents involving the same injured party.
The first assault was committed in April last year when 20-year-old Moore pushed the woman causing her to fall to the ground. He then grabbed her by the feet and pushed her downstairs.
In July last year Moore grabbed the injured party round the neck and pinned her to the bed. The woman’s friend tried to pull the 20-year-old off and he pushed her, causing her to sustain an injury to her side.
He continued to grab his girlfriend by the throat until she passed out. Police arrived a short time later as the woman was leaving the flat by the fire escape. She had injuries to her neck and arms.
They went to arrest Moore and he struggled violently with them as they tried to place handcuffs on him.
It was revealed that sentencing in the case had been adjourned for a probation pre-sentence report. However, the 20-year-old failed to show up for appointments because he “couldn’t be bothered” leaving the house early in the morning to walk to probation office.
District Judge Barney McElholm said he would sentence him without a report as he was “not getting a second chance”.
Defence counsel Catherine Devlin told the court the incidents were “horrific and appalling” and that Moore accepted that. She claimed the relationship between the couple was marred by domestic violence on both sides and the relationship was volatile and intense.
Ms Devlin said the relationship was now over and Moore was “ashamed and embarrased for what he has done”.
