Man accused of assaulting wife in bed

A Waterside man has appeared in court accused of breaking into his wife’s house and assaulting her as she slept in her bed.

Peter McIntyre, of Spencer Road, is charged with burglary with intent to inflict grievous bodily harm, assault occasioning actual bodily harm and criminal damage.

He is also accused of theft, making a threat to kill and a threat to damage property on July 21.

The 31-year-old is further charged with assault, criminal damage and theft relating to an alleged incident on April 26.

Derry Magistrate’s Court heard allegations that during this incident McIntyre had a heated argument with his wife and put his hands around her throat. He also allegedly smashed her phone by throwing it against the wall and has been accused of stealing the sim card from it to stop her phoning police.

An investigating officer told the court McIntyre was released on police bail for these offences and was banned from contacting his wife or entering the street where she lives.

She told the court the woman claims she was subjeced to a second “vicious” assault by her husband at the weekend, where he allegedly punched, headbutted and choked her.

Opposing bail, the officer said there was a history of domestic violence and McIntyre has an “extensive criminal record”.

Defence solicitor Paddy MacDermott said the case involves “allegation and counter-allegation”. He revealed his client is currently on crutches and alleges his wife threw him downstairs.

Mr MacDermott claimed the incident arose when McIntyre found his wife in bed with someone else.

However, he told the court his client denies all allegations of violence against the woman.

District Judge Barney McElholm agreed to adjourn the bail application after voicing concerns about McIntyre’s address.

The judge added the defendant “would not automatically get bail” if a different address is available.

McIntyre was remanded in custody and will appear in court again on July 30.
