Man fined for assault over bike
A father of four who assaulted a man he believed had stolen his bike has been fined at the local magistrates court.
Peter Jonathan Wade, of Stradowen Park, pleaded guilty to one charge of common assault on September 29, last year.
Derry Magistrates Court heard the injured party was stopped by the 31-year-old as he was on a bike in the Sevenoaks area of the Waterside.
Wade claimed the bike was his and it had been stolen over a month ago. However, the injured party said he had bought the bike on Gumtree a long time before that.
The court was told Wade asked the man to get off the bike and when he refused pushed him. Wade took the bike into his house and police were called.
During interview, the 31-year-old stated he had never put his hands on the injured party and he only asked him to get off he bike so he could check the serial umbers.
Defence solicitor Michael McGee said the injured party’s bike was “identical” to the bike that had been stolen from his client.
He said Wade knows his behaviour was “out of order” and accepts he was wrong.
Fining Wade £150, Deputy District Judge Peter King said he was prepared to deal with the case as a “momentary lapse of judgement”.
“This is a case of taking the law into your own hands and it escalated. The injured party in no way, shape or form deserved to be treated the way he was by you”.
The judge added it was “only a matter of good luck he wasn’t seriously injured” in the assault.
