Price ‘fit to travel’ - court told

Court news from the Donegal Democrat.

Court news from the Donegal Democrat.

A medical report has found that Marian Price would be “fit” to travel to court in Belfast.

Price, who is named on court papers as Marian McGlinchey, of no fixed abode, is accused of aiding and abetting addressing a meeting in support of the IRA.

The charges relate to an incident during a dissident republican commemoration in the City Cemetery in Derry on April 25, 2011.

Price, who was convicted of bombing the Old Bailey, had her licence revoked when she was charged with the offence and has been in custody ever since.

She was then moved to the City Hospital in Belfast, because of what her defence team describe as her “deteriorating mental and physical health”.

There has been considerable legal argument about how the case was to proceed and at one stage a judge was considering whether or not to hold a hearing in the hospital.

However, he dismissed this as an option and has been investigating whether or not the case can be transferred to Belfast for a preliminary investigation.

District Judge Barney McElholm told the court this morning that a medical report - written by a doctor agreed by both the prosecution and defence in the case - concluded that Price was “fit” to travel from the hospital to Laganside court in Belfast.

He revealed that the doctor recommends that the hearing takes place in 40 minute segments and then let Price have a 15 minute break.

Judge McElholm said it would be his intention to fix a date for the hearing in Belfast as the doctors opinion was “clear”.

The case was adjourned until March 28 to fox a date.
