Suspended sentence for stamping on man’s head

A 24-year-old who stamped on a man’s head during a fight has received a suspended jail term.

Patrick Martin Fisher, of Creggan Heights, pleaded guilty to disorderly behaviour on April 29, last year.

Derry Magistrate’s Court heard that the injured party did not give a statement to police about the incident, but it was captured on CCTV on the Strand Road.

The court was shown footage which the prosecution accepted showed both men were “looking for a fight”. Fisher took off his top and was seen to stamp on the man’s head, who then lay on the ground not moving for a number of minutes.

During police interview the 24-year-old said he was very drunk and didn’t really remember the incident, which occurred on his birthday.

Suspending a four month jail term for three years, District Judge Barney McElholm said stamping on someone’s head was “something the court is going to express strong disapproval of.

“There is far too much of that going on and one of these days someone is going to be left extremely brain damaged or dead”.

The judge also ordered Fisher to pay £500 to Foyle Search and Rescue “to make atonement for this type of behaviour”.
