Port admits keeping illegal waste

Derry's Port and Harbour Commissioners and two directors of a recycling company, all of them based at Port Road in the Lisahally area of the city, have all pleaded guilty to breaching environmental control legislation at Lisahally docks.

The Commissioners, as well as Sinead O'Hara and Damien Foley, both directors of Foyle Recyclers Limited, pleaded guilty at the Crown Court in Derry today to illegally keeping controlled waste at the quayside docks in Lisahally on dates between November 2006 and November 2007.

Foyle Recyclers Limited, which has two previous convictions for similar offences, also pleaded guilty to illegally depositing, disposing of and treating controlled waste at the quayside docks between the same dates.

The prosecuting agency in the case is the Northern Ireland Environment Agency. Four other associated charges are to be kept on file.

A prosecution barrister said that , as a result of the guilty pleas to charges which the defendants had originally denied, a confiscation application under the Proceeds of Crime Act would be made against the three defendants.

Judge Piers Grant adjourned sentencing until after the confiscation hearing takes place next June.
