Man’s assault on ex-partner ‘a moment of madness’

A 25-year-old Limavady man who assaulted his ex-partner in front of their five-year-old daughter said it was “a moment of madness”, a court has been told.

Richard Stewart from Anderson Crescent was sentenced for the offence of common assault when he appeared at Limavady Magistrate’s Court on Wednesday.

The court heard on February 23 at 7pm Stewart arrived at the injured party’s address and pushed past her, when their five-year-old daughter was present.

Stewart grabbed his ex-partner by the throat, slapped her and dragged her into the living room. The court heard he also kicked her on the leg.

When police arrived the injured party was visibly shaken and upset, and there were marks on her body from where she had been assaulted.

At 8.10pm that evening, Stewart was arrested amd taken to Coleraine Custody Suite.

Stewart said there were ongoing issues. He admitted dragging his ex-partner into the living room, but he denied kicking her.

A defence solicitor for Stewart said during the time Stewart and the woman had been in a relationship there had been no issues of this manner, and he said it had been “a moment of madness’.

She said Stewart had gone to the house to sort out financial issues and had hoped to see the child, but “things got out of hand”.

The solicitor said Stewart regretted his actions immediately, that he was “extremely remorseful” and “horrified by his behaviour”.

“He knows it was wrong,” said the solicitor, whe added that Stewart made admissions from the outset and fully accepted it was a serious matter.

District Judge Liam McNally said it was a “very serious” assault where the victim had been grabbed by the throat, kicked on the leg and humiliated in an aggravated way because it was done in view of the five-year-old child.

In sentencing, Judge McNally noted Stewart’s clear record, that there was no previous history and his plea of guilty.

Judge McNally sentenced Stewart to 150 hours of community service.
