Accused of sexual assault on nurse

A man accused of sexually assaulting a nurse in Altnagelvin Hospital has been refused bail

Joseph Gallagher, of Glenvale Road, is charged with sexual assault, indecent exposure, assault and disorderly behaviour in relation to an incident in the hospital on June 26.

The 21-year-old is further charged with assault occasioning actual bodily harm, possession of a glass bottle, and assaults on April 27.

Derry Magistrates Court heard that the first incident was an assault in the city centre. Gallagher was allegedly seen throwing punches at the injured party as he lay on the ground as a co-accused stamped on the man’s head. He was released on bail in relation to this incident but failed to turn up to court and an arrest warrant was issued.

It is alleged police finally caught up with Gallagher when they were called to Altnagelvin Hospital. It is alleged the 21-year-old was aggressive and assaulted a number of staff.

He allegedly abused other patients waiting for treatment and began headbutting walls and floors.

The court heard further allegations that he put his hands down his trousers, grabbed a nurse in the crotch and exposed his penis to an auxillary nurse.

Opposing bail, an investigating officer said police fear Gallagher would commit further offences, interfere with witnesses and pose a “serious risk to members of the public”.

District Judge Barney McElholm said that there was no change of circumstances since bail was refused in July this year.

He added “this sort of behaviour is utterly deplorable” and the community should not be put at risk of further offences”.

Gallagher will appear in court again on September 26.
