A man has been remanded in custody after he appeared at Derry Magistrate’s Court charged with sexual assault on a woman.
Jan Grzegorz (43) of 21, Deramore Drive in Strathfoyle was charged with the sexual assault that was alleged to have occurred on December 2.
The court was told that he had been given police bail to appear at Derry Magistrate’s Court at the end of the month but that he had breached the bail conditions yesterday.
The court was told that the the alleged injured party was in her home and the defendant tried to push in the door to gain access.
There was allegedly some pushing and then the defendant was said to have touched the woman inappropriately in the groin area.
After being interviewed by police Grzegorz was released on police bail to reside at an address not far from where the alleged injured party lived.
Yesterday morning the alleged injured party told police she saw the defendant near her home in breach of his bail conditions.
Defence solicitor Mr. Paddy MacDermott said his client had made ‘strenuous denials’ during interview and would be contesting the charge although he accepted the breach of bail.
The court was told that the defendant had gone to a house close to the injured party’s to meet his wife and had made no attempt to contact the alleged injured party.
He said the defendant’s wife was alone in a foreign country and had felt lonely.
The solicitor said that the defendant was trying to get accommodation away from the area altogether but the problem was money.
He added that Grzegorz now realised the need to adhere to all bail conditions.
District Judge Barney McElholm said he would not have granted bail to an address so close to the alleged injured party.
He added: “It is well past time we put the victim first in cases like tis and I really feel that 500 metres is far, far to close.
“People have to feel safe.”
He refused bail and remanded Grzegorz in custody to appear again on February 12.
