Fined for holding phone while driving

A Gleneely woman has been fined for holding a mobile phone while driving.

Teresa Diver, Carrowmore was detected at Newpark Road, Carndonagh on March 25, 2015.

Carndonagh District Court heard that Diver was not “using” the phone at the time, but was holding it in her hand after her grandaughter gave it to her when it began to ring. Diver had pulled in to answer the call when Gardai then knocked on her window. She has no previous convictions or penalty points.

Defence solicitor Ciaran MacLochlainn said Diver did not pay her fixed penalty fine as she was advised to contact the fixed penalty office and explain the circumstances. He said she was told a “certain course” would be taken but this did not happen. Judge Paul Kelly fined Diver 50 euro.
