Fined for unprovoked assault after argument

A Galliagh man who admitted an unprovoked assault has been fined.

Martin Anthony O’Connor committed the assault moments after he was set upon by up to five people.

O’Connor, of Carnhill, pleaded guilty to common assault on September 12, last year.

Derry Magistrate’s Court heard the injured party became aware of an argument involving O’Connor but it was over by the time he arrived at the scene.

The 20-year-old punched the man to the side of his head causing swelling to his ear.

This attack was completely unprovoked.

A defence barrister said his client ‘was subject to an unprovoked assault

himself’ moments

before this.

O’Connor was knocked to the ground and when he regained consciousness he ‘lashed out at the nearest person to him’.

Fining the 20-year-old £250, District Judge Peter King said there is ‘nothing on you record to suggest this is the sort of behaviour you routinely engage in’.
