Ex City of Culture marketing chief Garbhan Downey, who took his former employers to an industrial tribunal accusing them of unfair dismissal, has lost his case, the ‘Journal’ has learned.

Mr Downey was sacked by the Culture Company in January 2013. This followed his suspension in October 2012 after he voiced fears that marketing funding for 2013 could be re-directed by Derry City Council. The Culture Company had accused Mr. Downey of gross misconduct regarding the release of a letter sent by the Chief Executive of Derry City Council, Sharon O’Connor, to the Culture Company.

Final submissions were made to the tribunal panel in Belfast last December. The tribunal is expected to publish its findings early next week.

Speaking to the ‘Derry Journal’ this afternoon, solicitor Des Doherty, who represented Mr. Downey, confirmed that his client’s case had been unsuccessful.

He said: “We have received the judgement of the tribunal and are in the process of studying the same. We are considering an appeal.”
