Street drinker fined for disorderly behaviour

A street drinker who was abusive to police has been fined £200.

Damien Leo Mahoney, of Damien House, pleaded guilty to disorderly behaviour and resisting police on July 8.

Derry Magistrates Court heard police spoke to the 51-year-old because he was consuming alcohol in a public place in breach of council by-laws.

Mahoney became abusive telling the officer to ‘f*** away off home’ and ‘I hope you get a puncture’.

He was warned about his behaviour but continued to be abusive and was arrested.

The defendant wrestled with his arms as police tried to restrain him.

Defence solicitor Keith Kyle said his client has difficulties with alcohol and has a criminal record for similar offences. It was revealed Mahoney was also in breach of a suspended sentence.

Fining the 51-year-old, District Judge Barney McElholm warned ‘if I see him back again any time soon he will be going to prison’.
