Suspended term for disorderly behaviour

A 27-year-old Waterside man who jeered at police while resisting arrest outside a city centre pub, was handed a suspended sentence at Derry Magistrate's Court on Friday.

Phillip Devenney, of Riverview Terrace, Derry, was convicted of disorderly behaviour, resisting police and behaving indecently on November 22 last year.

A Public Prosecution Service solicitor (PPS) told the court that the PSNI was tasked to a reported incident outside the Bentley Bar in Market Street in the early hours of November 22.

CCTV footage showed the defendant throwing punches and urinating outside the bar, the solicitor said.

The court heard Devenney shouted abuse towards a female bar steward during the course of the incident.

Devenney also referenced the August 2010 bomb attack on the Strand Road PSNI station, the court heard, hailing the bomber as a hero while the defendant was resisting arrest.

The defending solicitor for Devenney said his client accepted his behaviour had been “unsavoury in the extreme” and that he had regretted it.

He said the defendant had a relevant record but that he was currently in a “much more settled place”, given that his partner is currently expecting a child.

Devenney was handed a four month jail term suspended for two years for the disorderly offence.

He was also ordered to undertake a year long probation service organised drug and alcohol programme for resisting police and was fined £150 for engaging in indecent behaviour.
