Duo charged with fatal road crash granted bail

Two men have appeared at Derry Magistrate's Court in connection with the death of a 69-year-old man in April, 2013.

Pensioner David Richie, from the Tullyally area died as a result of the collision on the Glenshane Road close to Burntollet Bridge.

Appeariing at Court were 25-year-old Thomas Andrew Hyndman of Knockbrack Road, Ardmore who faces charges of causing death by dangerous driving and driving without insurance. Also before the Court was Stephen Edward Joseph Magee who is 33 and from Ivy Mead in the city. He is charged with causing death by dangerous driving.

During the preliminary inquiry into the case counsel for the defendants accepted there is a prima facie case to answer. Both men stated that they did not wish to call any witnesses or present any evidence at this stage in the case.

Mr Patrick McDaid, solictor for Mr Hyndman asked for extra counsel as there is a charge against him of causing grievous bodily injury to his co-defendant Mr Magee. District Judge Barney McElholm refused the request stating that he wouldn’t consider that situation to be “substantially complexed.”

Both Mr Hyndman and Mr Magee were released on their own bail of £500 to reside at their given addresses. They will return to Derry Magistrate’s Court on March 8 for arraignment.
