Bail refused after serious assault

Martin Joseph Neeson, whose address was given on court papers as Magowan Park, is charged with causing grievous bodily harm with intent on August 28.

He is further charged with possessing an offensive weapon with intent, namely a knife.

Derry Magistrate’s Court heard police were called to the Creggan address in the early hours of the morning.

The alleged injured party was lying on the ground and there was a large pool of blood surrounding his head and neck.

His breathing was ‘distressed and laboured and there was a gurgling sound’.

The court heard claims of blood coming from the man’s ear, nose and mouth and there was ‘a large dent to the back of his skull’.

Paramedics observed that the man’s skull was ‘shattered’ and there was blood splatter in the hallway and living room of the property.

Neeson was also in the property and allegedly covered in blood.

Opposing bail, an investigating officer said the 36-year-old is accused of another assault in which the complainant was also left with severe head injuries.

She added that police had fears Neeson would interfere with witnesses or commit further offences.

Defence solicitor Seamus Quigley said his client claims he was acting in self-defence.

He said Neeson admits assaulting the man but claims the more serious injuries were caused when he fell downstairs.

The solicitor said Neeson could be released on stringent conditions.

Neeson was remanded in custody to appear in court again on September 29.
